Terms of Service

1. Acceptance of Terms

By accessing and using Cofy Cat ("the App"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with these terms, do not use or access the App.

The App is intended for users who are at least 13 years old. By using the App, you represent and warrant that you are at least 13 years of age.

2. Use License

Permission is granted to temporarily download one copy of Cofy Cat for personal, non-commercial use only. This is a license, not a transfer of title. Under this license, you may not:

• Modify, copy, or distribute App materials except as allowed by the App's normal features
• Use the App or materials for a commercial service without our permission
• Attempt to reverse engineer, interfere with, or bypass the App or its security features
• Remove copyright, trademark, or proprietary notices from App materials

This license terminates automatically if you violate these restrictions and may be terminated by Cofy Cat at any time.

3. User Accounts

When you create an account, you must provide information that is accurate, complete, and current. You are responsible for safeguarding your account and for activity under your account.

You agree to:

• Provide accurate and complete information
• Maintain the security of your account
• Promptly update account information when needed
• Accept responsibility for activity under your account
• Notify us promptly of unauthorized use

4. User Content

The App allows you to create, import, post, link, store, share, and otherwise make available information, text, images, and other materials ("Content"). Content includes recipes, recipe imports, recipe photos, storage entries and photos, library reviews, taste notes, tasting thoughts, brew notes, scan photos from coffee analysis features, feedback, and other user-generated material. You are responsible for your Content, including its legality, reliability, accuracy, and appropriateness.

AI-Assisted Content: When you use AI-assisted recipe import, parsing, image processing, or similar features, your submitted input may be processed by NVIDIA Build or another disclosed AI provider. Outputs you accept or save become your Content. You are responsible for reviewing AI outputs before relying on, saving, publishing, or sharing them.

By posting, saving, or making Content available through the App, you grant us the rights needed to operate Cofy Cat, including the right to:

• Use, host, store, reproduce, modify, reformat, translate, display, and distribute your Content in connection with the App
• Allow other users and visitors to view, share, and interact with Content you make public
• Back up, moderate, analyze, and secure your Content for service continuity and policy enforcement
• Create derivative works from your Content for App operations, such as formatting, thumbnails, translations, summaries, search indexes, and accessibility or localization improvements

This license is worldwide, royalty-free, non-exclusive, and sublicensable only as needed to operate, secure, support, and improve the App. For private Content, the license lasts while needed to provide the service and handle backups, deletion, legal, security, or support obligations. For Content you make public, the license continues as needed to display existing public surfaces, preserve service integrity, and maintain backups or records after deletion where lawful.

You retain ownership of your Content. We will not sell your Content to third parties without your explicit permission.

You represent and warrant that:

• You own the Content or have the necessary licenses, rights, consents, and permissions
• Your Content does not infringe third-party intellectual property, privacy, publicity, or other rights
• You have obtained all required permissions from any person appearing in your Content
• Your Content does not include sensitive personal information about others unless you have the legal right to provide it

5. Prohibited Uses

You may not use the App:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, state, or local laws or regulations
• To infringe our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false, misleading, fraudulent, or deceptive information
• To upload or transmit viruses, malware, or other harmful code
• To collect, expose, or track personal information of others without permission
• To spam, phish, pharm, pretext, spider, crawl, scrape, or abuse App infrastructure
• To upload objectionable, obscene, abusive, or illegal Content
• To interfere with or circumvent App security, App Check, rate limits, entitlement checks, or access controls

6. Content Standards

All Content must comply with these standards:

• Be accurate where it states facts
• Be genuinely held where it states opinions
• Comply with applicable law
• Respect third-party intellectual property, privacy, publicity, and contractual rights
• Avoid unnecessary personal data, confidential information, receipts, identifiers, precise location details, or images of people who have not consented

Content must not:

• Contain defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable material
• Promote sexually explicit or pornographic material
• Promote violence, discrimination, illegal conduct, unsafe conduct, or harmful misinformation
• Infringe any patent, trademark, copyright, trade secret, or other intellectual property right
• Violate the legal rights, privacy, or publicity rights of others
• Contain material that could give rise to criminal or civil liability

7. Intellectual Property Rights

The App and its original content, features, design, models, software, documentation, and functionality, excluding Content provided by users, are and will remain the exclusive property of Cofy Cat and its licensors. The App is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

User-generated recipes and other user Content remain the property of their creators, subject to the license granted in Section 4.

8. Privacy

Your use of the App is also governed by our Privacy Policy. Please review the Privacy Policy, which explains what data we collect, how we use it, third-party services we rely on, retention and deletion practices, and how to exercise privacy choices.

9. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, at our discretion, including if you breach these Terms, create risk for users or the App, violate law, or misuse the service.

If you wish to terminate your account, you may:

• Stop using the App
• Delete your account through Settings
• Contact us at yordlejason@gmail.com to request account deletion outside the App

Deleting your Cofy Cat account does not automatically cancel subscriptions managed by the App Store or Google Play. You must manage those subscriptions through the applicable store or Customer Center where available.

Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination will survive, including ownership, Content licenses, disclaimers, limitations of liability, indemnification, dispute terms, and payment obligations.

10. Disclaimer

The App is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Cofy Cat excludes all warranties and representations relating to the App and its contents.

Coffee, tea, brewing, grinder, scanner, OCR, scale, recipe, caffeine, and AI-assisted outputs are estimates and informational tools only. They may be inaccurate, incomplete, unavailable, delayed, or unsuitable for your equipment, ingredients, health needs, or preferences. You are responsible for reviewing outputs, using safe brewing practices, and deciding whether to rely on any recommendation.

The App is not medical, nutritional, safety, financial, or legal advice. Do not rely on Cofy Cat as a substitute for professional advice, product safety instructions, allergy information, or your own judgment.

To the fullest extent permitted by law, Cofy Cat excludes liability for damages arising out of or in connection with your use of the App, including direct loss, indirect loss, loss of business or profits, damage to devices or equipment, loss of data, service interruptions, unauthorized access, or reliance on generated or analyzed outputs.

The limitations and prohibitions of liability in this Section and elsewhere in these Terms apply even if Cofy Cat has been advised of the potential loss.

11. Limitations of Liability

Cofy Cat and its affiliates are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages related to your use of the App, including loss of profits, data, goodwill, service interruptions, subscription interruption, content loss, device or equipment damage, inaccurate analysis, or unauthorized access, to the fullest extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Cofy Cat, its licensors, officers, employees, contractors, and agents from claims, damages, losses, liabilities, costs, and expenses arising from your use of the App, your Content, your violation of these Terms, or your violation of any law or third-party right.

13. DMCA Compliance

If you believe content in the App infringes your copyright, contact us with a valid DMCA notice including the copyrighted work, the location of the allegedly infringing material, your contact information, required statements, and your physical or electronic signature.

14. Third-Party Services, Purchases, and Subscriptions

The App integrates with or relies on third-party services, each governed by its own terms and privacy policy:

• Firebase / Google Cloud: Authentication, database, storage, cloud functions, App Check, Remote Config, and hosting
• Google Sign In / Apple Sign In: Account authentication
• NVIDIA Build / NVIDIA-hosted AI models: AI-assisted recipe import/parsing and requested image processing workflows
• Amplitude: Usage analytics and event tracking
• RevenueCat: Purchase, subscription, entitlement, restore, webhook, and Customer Center management
• App Store / Google Play: In-app purchases, subscriptions, billing, renewals, cancellations, and refunds
• Google ML Kit: On-device storage label OCR on supported devices
• Device operating-system services: Camera, photo picker, notifications, Live Activities, Bluetooth, file export, and native share sheets

Cofy Cat Pro purchases and subscriptions are processed by the App Store, Google Play, RevenueCat, or the applicable platform provider. Prices, taxes, trials, renewals, cancellations, refunds, payment methods, billing disputes, and family-sharing or store account behavior are governed by the applicable store and provider terms. Unless required by law or store policy, fees already paid are non-refundable by Cofy Cat. We may change, add, remove, or limit paid features prospectively, but we will not intentionally remove paid access you are entitled to during an active paid period except where required for security, legal compliance, provider restrictions, or breach of these Terms.

We are not responsible for the acts, omissions, outages, billing decisions, data practices, or policies of third-party services.

15. Dispute Resolution

Disputes are resolved through good-faith negotiation, then binding arbitration where applicable, with small claims as permitted. You agree to individual dispute resolution and waive class actions to the fullest extent permitted by law.

16. Severability

If any provision is unenforceable, remaining provisions remain in effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and legal notices in the App, form the entire agreement between you and Cofy Cat.

18. Governing Law

These Terms are governed by the laws of California, United States.

19. Changes to Terms

We may update these Terms. Continued use after updates means you accept the revised Terms.
